The Ex-Emir Sanusi’s Expulsion From Kano Has Been Overturned By The Court

Touchaheart Nigeria reports that the removal of the deposed Emir of Kano state, Sanusi Lamido Sanusi II, from the state has been deemed unlawful by Justice Anwuli Chikere of the Federal High Court in Abuja.

Justice Anwuli Chikere ruled Monday, November 30, that the state government’s use of the Emirate Council Law, 2019, to deport Sanusi was in violation of the 1999 Constitution of the Federal Republic of Nigeria, as amended.

She said that the country’s constitution was supreme, and that any law that contradicted it was void.

According to the judge, the former emir has the constitutional right to live anywhere in the country, including Kano State.

Sanusi, who was deposed on March 9, 2020, sued the Inspector-General of Police and the Director-General of the Department of State Services on March 12, 2020, for what he described as “unlawful detention/confinement.”

The Attorney-General of Kano State and the Attorney-General of the Federation were named as third and fourth respondents in the complaint, respectively.

Sanusi did not contest his dethronement, but he did ask the court for an interim injunction releasing him from the respondents’ imprisonment and/or incarceration and restoring his right to human dignity and personal liberty.

The first, second, and third respondents were also barred from harassing him further, according to Justice Chikere, who struck out the name of the AGF from the suit.

The court fined the first, second, and third defendants N10 million and ordered them to issue a public apology to the deposed emir in two national dailies.
