The NDLEA had filed an eight-count criminal complaint against him and six others, alleging that they were narcotics traffickers.

Four members of the Police Intelligence Response Team, IRT, were named as defendants in the charge marked FHC/ABJ/57/2022, which the agency filed before the Federal High Court in Abuja. The agency charged DCP Kyari and the four other police officers of conspiracy, obstruction, and dealing in Cocaine worth 17.55 kilograms in a charge filed by a team of lawyers led by its Director, Prosecution & Legal Services, Mr. Joseph Sunday.

It further claimed that Kyari and his associates, who are presently in its custody, tampered with 21.25 kilograms of Cocaine.

Umeibe and Ezenwanne were charged with plotting with others to bring 21.35 kg of cocaine into the nation.

The NDLEA filed the case against them just hours after the Attorney-General of the Federation and Minister of Justice, Mr. Abubakar Malami, SAN, approved Kyari’s extradition to the United States to face trial.

Malami said in the extradition motion he also filed before the court that DCP Kyari was not facing any charges in Nigeria.
